The Problem

Most gyms have a duty of care gap hiding in plain sight.

Your WHS documentation looks solid on paper. But when a member gets injured on the gym floor and you can't produce a near-miss history or an incident log — that's when the exposure shows.

Incident forms nobody fills out

Paper incident forms sit at the front desk or in the office. When a member tweaks their back on a machine with a worn pad, they move on. No form is submitted. No record is created.

Personal trainers have no reporting pathway

PTs — whether employed or independent contractors — see equipment issues, member near-misses, and floor hazards every session. They have no quick way to log what they observe.

Claims arrive months after the incident

A member who injured their shoulder in March may receive medical advice and engage a lawyer by August. When the claim arrives, your ability to defend it rests entirely on what was recorded in March.

How It Works

Deployed across your gym floor in under an hour.

QR codes at the entry, free weights, machines, pool deck, and amenities. Any member or staff member can report in 60 seconds.

01

QR codes placed on the gym floor

Codes go up at the entry, near major equipment zones, the pool deck, change rooms, and the front desk — wherever incidents are most likely.

02

Members and staff scan and report

Any person in the facility — member, personal trainer, or casual staff — scans with their phone. No app. No login. Report submitted in under a minute.

03

Manager alerted immediately

Your gym manager or nominated duty officer receives an instant notification. Equipment gets tagged, hazards get addressed, and the response is logged.

04

Complete incident history maintained

Every report is timestamped and stored permanently. When a claim or insurer query arrives, your full incident history is retrievable in seconds.

Who It's For

Built for every role in your gym.

From the floor manager to the franchise owner — GuardSync gives every role visibility and protection.

Gym Managers & Owners

You carry duty of care for every member on the floor. GuardSync gives you real-time incident visibility across the entire facility — and a complete audit trail that protects you when a claim arrives.

Personal Trainers

Whether you're employed or an independent contractor, you see what happens on the floor. GuardSync's one-scan reporting means you can log a near-miss in 60 seconds without interrupting a session.

Franchise Groups & Multi-Site Operators

Running multiple locations means multiple concurrent exposures. GuardSync consolidates incident data across all sites — giving you pattern recognition across your network that individual site managers cannot see.

Insurance & Risk Managers

At renewal time, demonstrating systematic incident management lowers your risk profile. GuardSync's complete incident history is exactly the evidence underwriters want to see.

Regulatory Obligations

What duty of care actually requires from gym operators.

Australian fitness industry operators carry clear legal obligations under WHS law and negligence principles. Here's what GuardSync directly supports.

WHS Act 2011 s.19

As a PCBU, gym operators must ensure the health and safety of workers — including personal trainers, cleaning contractors, and any other person carrying out work on the premises.

Duty of care to members

Members are invitees with the highest duty of care. Operators must maintain equipment in a safe condition, identify and address hazards, and maintain records of known risks.

Equipment maintenance records

Operators must demonstrate that equipment was regularly inspected and known faults were acted upon. Near-miss reports are critical evidence of this systematic management.

Incident notification

Serious injuries must be reported to SafeWork. The regulator may request supporting incident documentation — a paper-based log that was not completed is worse than no system at all.

Membership agreement limitations

Liability waivers in membership agreements do not extinguish duty of care obligations. Courts have consistently found that reasonable precautions must still be taken and documented.

Insurance policy obligations

Most fitness industry liability policies require incident records to be maintained and incidents to be reported within a specified period — failure to produce records can affect coverage.

A gym operator who cannot produce a contemporaneous record of a known equipment defect — where a member was subsequently injured using that equipment — is in a very difficult position to defend, regardless of any waiver signed at membership intake.

Without vs With GuardSync

What happens when a member makes a claim.

The difference between a defended claim and an indefensible one is whether there's a record of what you knew and what you did about it.

Without GuardSync

  1. 01Member notices worn cable on lat pulldown machine
  2. 02Tells the front desk verbally — no record created
  3. 03Another member uses the machine and is injured
  4. 04Claim arrives. Insurer asks for equipment fault history.
  5. 05No record exists. Prior knowledge assumed. Full settlement.

No record. Prior knowledge presumed. Full exposure.
