Australian strata legislation and occupier's liability law create clear obligations for owners corporations and strata managers. GuardSync is built to satisfy each of them.

Strata Schemes Management Act 2015 (NSW)

Owners corporations must maintain common property in good and serviceable repair. Failing to act on a known hazard is a breach of this statutory duty — and "we didn't know" is not a defence if residents had no system to report it.

Duty of care to all occupants and visitors

Residents, guests, contractors, and delivery personnel are all owed a duty of care in common areas. GuardSync creates the documented evidence that this duty is being actively and consistently discharged.

WHS Act 2011

Incident recording requirements

Serious injuries must be notified to SafeWork. Records must be kept in a retrievable format for a minimum of five years. A text message thread does not meet this standard.

Limitation periods

Property damage claims can be brought up to six years after the event. Personal injury claims up to three years. Your incident records need to outlast these windows — and be retrievable in seconds.

Where a hazardous condition existed in a common area and no system was in place to capture, record, and escalate reports from occupants, the owners corporation cannot credibly assert it exercised reasonable care. The absence of a reporting mechanism is itself evidence of systemic neglect.
